ClaimsAssist – Terms of Use (Singapore)

The following are terms of a legal agreement between you and ClaimsAssist (hereinafter referred to as CA) in respect of your use of www.claimsassist.com.sg and the Claims Management Platform.
By downloading, accessing, browsing or using the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set out in this terms of use for the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg (hereinafter referred to as the “Terms of Use”) and to comply with all applicable laws and regulations.
If you are not agreeable to these Terms of Use, please stop using immediately.
1. General
1.1 We reserve the right to change the Terms of Use and any other information contained in the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg at any time without notice. It is your responsibility to check the Terms of Use and ClaimsAssist Claims Management Platform and www.claimsassist.com.sg updates periodically for changes. The updated changes and your continued use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg after such changes will constitute your acceptance and agreement to the modified Terms of Use.
1.2 We may modify, suspend, discontinue or restrict the use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg, any portion thereof or any content at any time with or without notice.
1.3 TheClaimsAssist Claims Management Platform and www.claimsassist.com.sg does not constitute submission or approval of a claim and ClaimsAssist Claims Management Platform and www.claimsassist.com.sg may not represent the insurance company that you are submitting the claims to.
2. Proprietary Rights
2.1 The ClaimsAssist Claims Management Platform and www.claimsassist.com.sg are maintained by The Specialist Opinion Pte Ltd (hereinafter referred to as TSO).
2.2 The materials displayed in theClaimsAssist Claims Management Platform and www.claimsassist.com.sg, including but not limited to the information and software programmes, all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (the “Contents”), are protected by copyright, trademark and other forms of proprietary rights. All rights, title and interest in the Contents are owned by, licensed to or controlled by TSO.
2.3 Except as expressly provided for in these Terms of Use, no part of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and no contents may be copied, reproduced, republished, uploaded, posted, publicly displayed, transmitted or distributed in any way to any other medium for publication or distribution or for any commercial enterprise, without TSO’s prior written consent.
2.4 You may only use the information (and where applicable) made available for downloading for the purpose of the use of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg.
3. Privacy Policy
3.1 As part of the registration process, or as part of the continued use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg, you agree that any registration information you give to ClaimsAssist Claims Management Platform and www.claimsassist.com.sg, through the means of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg, will always be accurate, correct and up to date.
3.2 You hereby consent that our Claims Specialist(s) contact you for identity check, responding to any inquiries, communicating on follow up and feedback investigation.
3.3 Accordingly, you agree (i) to have read and agreed with ClaimsAssist Claims Management Platform and www.claimsassist.com.sg Personal Data Protection; and (ii) understand that you are solely responsible for all activities that occur under your account. If you are aware of any unauthorised use of your account, you agree to notify ClaimsAssist Claims Management Platform and www.claimsassist.com.sg immediately.
4. Personal Data Protection
4.1 ClaimsAssist Claims Management Platform and www.claimsassist.com.sg may generate and compile information about you. Personal information provided by you and all information generated and compiled by ClaimsAssist Claims Management Platform and www.claimsassist.com.sg about you from time to time is collectively referred to as “Your Personal Data”.
4.2 The purposes for which Your Personal Data may be used are as follows:
4.2.1 offering and providing services and products to you, which may include, insurance services and products;
4.2.2 processing and assessing applications or requests made by you in connection with ClaimsAssist Claims Management Platform and www.claimsassist.com.sg services or products, issuing or arranging insurance contracts and maintaining your account with ClaimsAssist Claims Management Platform and www.claimsassist.com.sg;
4.2.3 marketing services and products to you
4.2.4 operating, maintaining and providing subsequent services in relation to the applications for services and/or products;
4.2.5 data compilations and statistical analysis;
4.2.6 exercising any rights that ClaimsAssist Claims Management Platform and www.claimsassist.com.sg may have in connection with the services and/or products provided to you;
4.2.7 verifying and conducting any eligibility, credit, physical, medical, security, underwriting and/or identity checks in connection with provision of services or products;
4.2.8 any purposes in connection with any claims made by or against or involving you;
4.2.9 complying with a foreign and domestic laws and regulations codes of practice or guidelines applicable to ClaimsAssist Claims Management Platform and www.claimsassist.com.sg or affiliated companies of TSO;
4.2.10 meeting commitments with any legal, regulatory, governmental, tax, law enforcement or other authorities, industry bodies in Singapore or any other jurisdictions where ClaimsAssist Claims Management Platform and www.claimsassist.com.sg has presence or business;
4.2.11 complying with policies and procedures applicable within the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg; and
4.2.12 any other purposes directly related to (4.2.1) to (4.2.12) above.
4.3 ClaimsAssist Claims Management Platform and www.claimsassist.com.sg may disclose Your Personal Data with the following parties, whether within or outside Singapore for the purposes described in paragraph 4.2 above:
4.4 members of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO;
4.5 persons or companies acting for or on behalf of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO (e.g. Claims Specialists);
4.6 persons or companies carrying on insurance or reinsurance-related businesses engaged by ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO;
4.7 physicians, hospitals, clinics, medical practitioners, laboratories, technicians, loss adjustors, risk intelligence providers, claim investigation companies, administrators or other professional advisors engaged by ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO
4.8 third parties, including distributors, intermediaries, agents, contractors or service providers that provide services in relation to ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO businesses; and/or
4.9 persons or companies to whom ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO or the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO group has to make disclosure under any law, rules, regulations, codes of practice or guidelines (whether applicable in or outside Singapore).
5. App Updates
5.1 The ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO which you use may require you to install updates from time to time. These updates are designed to improve, enhance and further develop the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO and may take the form of bug fixes, enhanced functions, new modules and completely new versions. You agree to receive such updates as part of your use of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO.
6. Restrictions on use of Materials
6.1 Except as otherwise provided, the contents of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission ofClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO.
6.2 Modification of any of the Contents or use of the Contents for any other purposes will be a violation of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO’s copyright and other intellectual property rights. Graphics and images on ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO are protected by copyright ang may not be reproduced or appropriated in any manner without written permission of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO.
6.3 You shall not: (a) remove any proprietary notice language in ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, the Contents or other documents (including copies of documents); (b) use the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, contents or other documents for any other purpose other than for your personal, non-commercial information on any networked computer or broadcast in any form of media; (c) make any modifications to ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, the contents or documents or any such information and (d) make any additional representations or warranties relating to ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, contents, documents or such other information.
6.4 You may not attempt to gain unauthorised access to any portion or feature of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, or to any of the services offered on or through the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO by means of hacking, password mining or any other illegitimate means. You may not probe, scan or test the vulnerability of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, nor breach the security or authentication measures of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO. You may not reverse engineer, trace or seek to trace any information on any other user or visitor of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO including but not limited to personal identification or information, other than your own information, as provided for by ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO or yourself.
7. Exclusion of Warranties and Limitation of Liability
7.1 You expressly understand and agree that your use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO is at your sole risk and that the services provided “as is” and “as available”.
7.2 In particular, ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, its subsidiaries and affiliates, and its licensors do not represent or warrant to you that:
a. Your use of the services will meet your requirements;
b. Your use of the services will be uninterrupted, timely, secure or free from error;
c. Any information obtained by you as a result of your use of the app will be accurate or reliable; and
d. Defects in the operation or functionality of any software provided to you as part of the services will be corrected.
7.3 Any material downloaded or otherwise obtained through the use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO is done at your own discretion and risk and you will be solely responsible for any damage to your device or loss of data that results from the download.
7.4 ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO shall also not be liable for any damage or loss of any kind caused as a result (direct or indirect) of the use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, including but not limited to any damage or loss suffered as a result of reliance on the Contents contained in or available from ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO.
7.5 You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO.
7.6 You agree not to use any device, software or routine to interfere or attempt with the proper working of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO or any transaction being conducted on theClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, or with any other person’s use of the ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO.
7.7 You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO on or through ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO or any service offered on or through ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.
7.8 You may not use ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO or any content for any purposes that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO or others.
7.9 You must not use ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO on any mobile device or operating system that has been modified outside the mobile device or operating system vendor supported or vendor warranted configurations, otherwise you will bear the associated risks and consequences which may arise from or in connection with your mobile device and the use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO. This includes mobile devices that have been ‘jailbroken’ or ‘rooted’. For the purpose of this Terms of Use of ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO, a jailbroken or rooted mobile device means one that has been freed from the limitations imposed on it by your mobile service provider and the mobile device manufacturer without their approval.
8. Right of Access
8.1 ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO reserves all rights to deny or restrict access to this ClaimsAssist Claims Management Platform and www.claimsassist.com.sg and TSO to any particular person, at any tie, without ascribing any reasons whatsoever.
9. Governing Law
8.1 These Terms of Use shall be governed and construed in accordance with laws of the Republic of Singapore.
