ClaimsAssist – Disclaimer (Singapore)

By accessing or using the ClaimsAssist platform (“Platform”), you (“User”) agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform.
1. Nature of Service
ClaimsAssist is a claims support and advisory platform operated by The Specialist Opinion Pte Ltd (“TSO”) that facilitates users in monitoring and managing insurance claims.
All information, tools, and guidance provided on the Platform are for general informational and administrative assistance purposes only and do not constitute legal, financial, insurance, or medical advice.
2. User Responsibility and Data Submission
You acknowledge and agree that:
All information submitted into the Platform is provided voluntarily and at your own risk;
You are solely responsible for the accuracy, completeness, and legality of the data you input;
TSO and ClaimsAssist shall not be responsible for any consequences arising from inaccurate, incomplete, or misleading information provided by you.
3. No Liability for Claims Outcomes
ClaimsAssist does not guarantee:
Approval of any insurance claim;
The amount or timing of any payout; or
Any specific outcome from insurers or third parties.
You agree that:
All claims decisions remain solely at the discretion of the relevant insurer or authority;
TSO and ClaimsAssist shall not be held liable for any rejection, delay, or dispute relating to your claim;
Any guidance provided is non-binding and does not create liability on TSO or ClaimsAssist.
4. Medical Disclaimer
The Platform may contain information relating to medical conditions, treatments, or healthcare providers.
You acknowledge and agree that:
Such information is provided strictly for general informational purposes only;
It does not constitute medical advice, diagnosis, or treatment recommendations;
TSO and ClaimsAssist are not healthcare providers and do not provide medical opinions.
You should always seek advice from a qualified medical professional regarding any medical condition or treatment.
TSO and ClaimsAssist shall not be liable for any reliance placed on medical-related information provided through the Platform.
5. Personal Data Protection (PDPA)
In accordance with the Personal Data Protection Act 2012 of Singapore (“PDPA”), you acknowledge and agree that:
5.1 Collection and Use
TSO and ClaimsAssist may collect, use, disclose, and process your personal data (including medical and insurance-related information) for purposes including:
Facilitating and administering your insurance claims;
Communicating with insurers, medical providers, and relevant third parties;
Improving Platform services and user experience.
5.2 Consent
By using the Platform and submitting your information, you consent to the collection, use, and disclosure of your personal data for the purposes stated above;
Where you provide personal data of third parties, you represent and warrant that you have obtained their consent.
5.3 Disclosure
Your data may be disclosed to insurers, healthcare providers, partners, and service providers where necessary to perform the Platform’s functions.
5.4 Data Protection Risks
While reasonable security measures are implemented, no system is completely secure;
You acknowledge and accept the risks associated with electronic transmission and storage of data.
5.5 Limitation of Liability (Data)
To the fullest extent permitted by law, TSO and ClaimsAssist shall not be liable for any unauthorised access, data breach, loss, or misuse of personal data.
6. Data Security and Risk
You acknowledge that:
Use of the Platform involves transmission of data over the internet;
TSO and ClaimsAssist do not guarantee uninterrupted or secure access at all times.
You agree that use of the Platform is at your own risk.
7. Indemnity
You agree to indemnify, defend, and hold harmless TSO, ClaimsAssist, and their directors, employees, and partners from and against any and all claims, liabilities, damages, losses, and expenses arising out of:
Your use or misuse of the Platform;
Your breach of these Terms;
Any data or content submitted by you.
8. Third-Party Services
The Platform may interface with third parties (including insurers and medical providers). TSO and ClaimsAssist:
Do not control or guarantee third-party services;
Are not responsible for any actions, omissions, or decisions made by such parties.
9. Limitation of Liability
To the maximum extent permitted under Singapore law:
TSO and ClaimsAssist shall not be liable for any indirect, incidental, consequential, or special damages, including loss of income, loss of opportunity, or loss of data;
Total liability, if any, shall not exceed the amount paid (if any) by you for use of the Platform.
10. Amendments
TSO reserves the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the Singapore courts.
